GENERAL TERMS AND CONDITIONS OF SALE OF VAQUEROS RANDO
1/REGISTRATION and PAYMENT
The general conditions of sale are acknowledged as read and approved upon receipt upon first payment (including deposit) or following an online registration via our website. The registration then becomes effective. In accordance with Article L.121-20-4 of the Consumer Code, persons registered for a service do not benefit from the seven-day withdrawal period.
1.1 Payment methods:
Check payable to VAQUEROS RANDO, cash, transfer (bank details provided on request) or online payment by credit card from our website.
1.2 Terms and conditions:
The customer undertakes, prior to any reservation, to complete the information requested on the site. The customer certifies the veracity and accuracy of the information transmitted. After the final choice of the services to be booked, the reservation procedure includes in particular the entry of the credit card, the consultation and acceptance of the general conditions of sale and the conditions of sale of the reserved rate before the validation of the reservation and, finally, the validation of the reservation by the customer.
The booking platform subcontracted by Ultinow acknowledges receipt of the customer's reservation by sending an email without delay. In the case of online booking, the acknowledgment of receipt of the reservation by e-mail summarizes the contract offer, the services reserved, the prices, the cancellation conditions relating to the selected rate, accepted by the customer, the date of reservation made, the information relating to the after-sales service, as well as the address of the seller's establishment to which the customer can submit his complaints. On the Internet via our online booking platform subcontracted by Ultinow, the balance of certain services is requested at registration regardless of the registration period before the service. When registering certain services, only the payment of an online deposit is requested. This is indicated in the "price category" on the platform. In this case the balance will be paid online or on site on the day of the activity by check, or cash.
Registration for more than 30 days: At registration, payment of a deposit of the amount indicated on the "Registration File". The balance will be paid no later than 7 days before departure. Registration less than 7 days: Payment of the total amount of the service,
2/CANCELLATION BY THE CUSTOMER
Any service cancelled less than 48 hours before the appointment will not be refunded for any reason. If you do not show up at the meeting point, the service will not be refunded.
2.1 – Withdrawal
If a person in a group withdraws less than 24 hours before the service, the service will still be invoiced for the person who withdraws.
It is up to you to be reimbursed by this person.
2.2 – Weather
Only the guide of Vaqueros Rando provided for the supervision of the service can cancel a service in case of bad weather conditions (rain, rainstorm, cyclone etc ...). If you wish to cancel the service due to bad weather conditions it is the guide of Vaqueros Rando will judge if the weather conditions do not allow to perform the service, if the weather conditions are considered bad to perform the service, 50% will be refunded.
2.3 Cancellation fees
If the service is cancelled more than 48 hours before the service, 60% of the total price of the service will be invoiced.
If the service is cancelled more than 7 days before the service, 40% of the total price of the service will be invoiced.
If the service is cancelled more than 14 days before the service, 20% of the total price of the service will be invoiced.
If the service is cancelled more than one month of the service 10% of the total price of the service will be invoiced.
2.4 Contract assignment
In case of transfer of the Registration File to a third party, the customer is required to inform Vaqueros rando no later than 7 days before departure by any means allowing to obtain an acknowledgment of receipt.
2.5 Changes before departure
Any change of service or dates must be notified no later than 30 days before the departure date by any means allowing to obtain an acknowledgment of receipt. Any modification request sent less than 30 days before the departure date is considered a cancellation and entails the application of the cancellation conditions of paragraph 2.3. The renunciation of one of the services included in a service can not be reimbursed.
2.6 Modifications during the service
Any program modification made at the request of the participant can only be implemented after agreement of the guide and the whole group. In this case, the additional costs incurred are borne by the participant.
2.7 Interruption of the service
Any service interrupted by decision of the participant (for reasons of health, level, or other) does not entitle Vaqueros Rando to any refund of unused services. Additional costs incurred by the participant as a result will not be reimbursed. Following medical repatriation by the participant's assistance, unused services cannot be refunded.
2.8 Notification of cancellation
Any notification of cancellation must be made by any means capable of obtaining an acknowledgement of receipt.
3/CANCELLATION BY THE SERVICE PROVIDER
3.1 Insufficient number of participants
Lack of sufficient participants. When the minimum number of 1 participants is not reached, the service can be cancelled no later than 6 hours before departure. In this case, the customer is informed by e-mail or telephone. The customer then has the choice between the full refund of the sums paid or the deferral up to the sums paid on another service of his choice. He is not entitled to any compensatory indemnity.
3.2 Case of force majeure
In case of force majeure (unforeseeable and insurmountable incidents or events such as: wars, political unrest, strikes, riots, weather conditions, natural disasters, etc.). Only the Vaqueros Rando guide provided for the supervision of the service can cancel the service for meteorological reasons related to the safety of participants and elements of a meteorological nature. 3.4 Changes before departure

These details are stipulated in the registration files, on the website and on the online booking platform. The guide in charge of the service can redefine a route at any time, so that it is as sheltered as possible from the weather conditions according to the level of the participants. The participant will not be able to cancel without losing the full price of the service.
3.5 Modifications during the services
For safety reasons or for organizational reasons related in particular to current weather conditions or group level, the program and itineraries may be subject to change. In these cases, only the guide is authorized to make the necessary decision(s) without notice. Vaqueros Rando may then be required to take charge of the additional services induced or to reimburse, except in cases of force majeure, the difference in price between the services provided and those provided.
3.6 Interruption of the service
Any service may also be interrupted by decision of the guide for duly justified reasons (safety, insufficient level, weather). In this case, unless the interruption is due to force majeure, Vaqueros Rando will refund the difference in price between the services provided and those provided.
4.1 Civil Liability
VAQUEROS RANDO is insured in professional liability with an insurance company. However, the responsibility of VAQUEROS RANDO does not replace the individual civil liability that each participant must hold.
4.2 Events external to

4.3 Rules of caution
The services taking place in the natural environment (at sea and on land), exemplary individual conduct and strict compliance with the safety rules formulated by the guide are requested from each participant. VAQUEROS RANDO cannot be held responsible for the individual carelessness of one or more participants. VAQUEROS RANDO reserves the right to exclude, at any time, one or more participant(s) whose behavior would endanger the safety of the group or its well-being, without any compensation being due to the offending participant.
4.4 Prerequisites and technical levels
Upon registration, each participant acknowledges knowing how to swim. He also acknowledges having a physical condition and a level of technicality of the corresponding service. VAQUEROS RANDO can not be held responsible in case of physical insufficiency revealed during the hike.
VAQUEROS RANDO agrees to welcome minors provided that their age, their physical fitness make it possible to carry out the service under normal conditions. Except during the services reserved for them, minors must be accompanied at least by one of their parents or any other adult authorized by them.

5.1 Equipment provided
The materials and equipment provided by VAQUEROS RANDO are listed in the technical sheet or registration file of the corresponding service. They are entrusted to the participant who becomes responsible for them during the duration of the service. Any deterioration may result in repair or replacement costs. As such, the participant is advised to ensure that his personal liability insurance policy covers any damage caused during a service. The participant is free to use his personal equipment under his own responsibility without being able to claim any reduction or compensation from VAQUEROS RANDO.
5.2 Material to be Planned.
The equipment to be provided is listed in the technical sheet of the corresponding service. It is important to control your equipment, safety, comfort and the smooth running of the service may depend on it. The customer is solely responsible for his personal equipment.
6.1 Price and payment :
The prices of VAQUEROS RANDO services include only transport, loan or rental of material and corresponding equipment. Ancillary costs: Most hikes are clearly defined in their rates and the resulting ancillary costs are detailed in the registration files. The services of accommodation, catering and sometimes transport during a trip are directly invoiced by the provider or may be the subject of a common fund organized and advanced by VAQUEROS RANDO. The prices of VAQUEROS RANDO's services have been calculated as accurately as possible according to the economic conditions known at the time of printing its documentation. They are applicable from publication until the day of publication of the following edition. They have no contractual value and are confirmed to the buyer upon registration. They are subject to possible changes that apply to all persons already registered or wishing to register. Promotions and discounts are neither cumulative nor retroactive. There may be a refusal of the payment card for several reasons: stolen card, blocked card, limit reached, input error ... 6.2 Small group supplement:
In order to avoid cancelling a service due to a lack of participants in sufficient number (see 3.1), VAQUEROS RANDO may offer a small group departure for an additional fee. The customer is then free to accept or refuse. In case of refusal, VAQUEROS RANDO reimburses him the sums paid. If on the day of departure the size of the group reaches the minimum number required, the supplement becomes undue by the customer, it is, depending on the case or not claimed.
Respect for privacy is a subject that is at the heart of the booking platform's concerns. The customer is informed, on each of the personal data collection forms, of the mandatory or optional nature of the answers by the presence of an asterisk. The information processed is only intended for the establishment and online payment providers. This information is not passed on to other third parties. When paying online, the customer's bank details must be transmitted by the payment provider Stripe.com to the bank of the establishment, for the execution of the reservation contract. However, the customer consents to this transfer necessary for the execution of his reservation.
